Overview

Welcome to muySafe! The terms “we”, “us” and “our” refer to muySafe. muySafe operates this store and website, including all related information, content, features, tools, products and services (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with our Privacy Policy, Refund Policy, and Shipping Policy, govern your use of the Services.

By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our referenced policies. If you do not agree, please do not use the Services.

1. Access and Account

You represent that you are at least the age of majority in your state or province of residence. You are responsible for the accuracy of any information you provide (including email, billing, payment, and shipping details) and for maintaining the security of your account. You are responsible for all activity that occurs under your account.

2. Our Products & Made-to-Order Work

We strive to depict products accurately, but colors and appearance can vary depending on device settings and material variations.

3D Printing & Manufacturing Nature: Due to the nature of Additive Manufacturing (3D Printing), products may exhibit visible layer lines, small support marks, or minor surface texture variations. These characteristics are inherent to the 3D printing process and are not considered defects.
Custom & Personalized Work: Many of our products are custom-made or personalized (e.g., laser engraving, 3D printing, sublimation, or other creative work). You may receive proofs or mockups for approval; your approval constitutes acceptance of the design.
Material & Finish Variations: Minor variations in texture, color, or finish (such as wood grain, cardstock tone, or filament sheen) are considered normal. We may make small technical adjustments to improve durability or quality without altering the design intent.
Intended Use & Safety: Unless explicitly stated otherwise, our 3D-printed products are intended as decorative items or collectibles and are not designed as heavy-duty toys or industrial-grade components.
- WARNING: 3D-printed items may contain small parts or sharp edges that pose a choking or injury hazard. These products are NOT intended for children under the age of 3. muySafe shall not be held liable for misuse or damages resulting from improper handling.
Availability: Descriptions and availability may change without notice. We reserve the right to limit or discontinue products at our discretion.

3. Orders & Custom Approvals

When you place an order, you are making an offer to purchase. muySafe may accept or decline any order at its discretion. Payment must be authorized before order acceptance.

For custom orders, production times depend on design approval and workload. Once an order or proof is approved, changes or cancellations may not be possible.

All purchases are subject to our Refund Policy.

Wholesale orders: Business and bulk purchases are subject to additional terms, including minimum order quantities, production scheduling, and customized pricing.

4. Prices, Billing & Taxes

Prices, promotions, and discounts are subject to change without notice. The price listed in your order confirmation applies at the time of purchase. Prices typically exclude taxes, shipping, and handling unless specified otherwise.

You agree to provide accurate and up-to-date payment and billing details. By submitting your payment information, you authorize us and Shopify’s payment processor to charge your selected payment method for all charges, including applicable taxes and shipping fees.

5. Shipping, Risk of Loss & Production Time

We take great care in packaging and shipping all orders.
Shipping and delivery estimates are not guaranteed and may be affected by carrier delays or external factors.

Since many of our products are made-to-order, additional production time may be required depending on design complexity and order volume.
If production exceeds 3 business days before shipment, we will contact you to confirm delivery expectations.

Risk of loss transfers to you once the product is handed over to the carrier.

6. Intellectual Property & Customer Content

All content and materials on this site (including but not limited to text, images, graphics, videos, logos, and digital designs) are owned by muySafe or its licensors and are protected by applicable intellectual property laws.

Inspired Designs & Fan Art: Some products may include designs inspired by popular culture or third-party characters ("Fan Art"). muySafe does not claim ownership of the original trademarks, names, or intellectual property of the third-party creators. These items are artistic tributes. The purchase price covers manufacturing time, materials, 3D printing services, and post-processing labor. If you are a rights holder and believe a design infringes upon your intellectual property, please contact us at cservises@muysafe.com for immediate review and removal.
Customer-Provided Content: If you submit logos, artwork, or design materials for custom orders, you grant muySafe a non-exclusive, worldwide license to use them solely for:
1. Producing and delivering your specific order.
2. Showcasing final results as portfolio, marketing, or sample work (unless you explicitly request otherwise in writing).
Customer Responsibility: You represent and warrant that you own or have the necessary rights to any materials you provide and that they do not infringe upon the intellectual property or privacy rights of any third party. muySafe reserves the right to refuse any custom order that appears to violate intellectual property laws or our Prohibited Uses policy.

7. Optional Tools

We may provide access to third-party tools “as is” and “as available,” without warranties. Your use of third-party tools is at your own risk and subject to their terms.

8. Third-Party Links

Our Services may include links to other websites or services operated by third parties. muySafe is not responsible for their content or policies. Review third-party terms carefully before interacting or making purchases.

9. Relationship with Shopify

muySafe is powered by Shopify, but all sales and customer transactions are between you and muySafe.
Shopify is not responsible for the quality, safety, or delivery of any products sold through our store. You release Shopify from any claims related to your purchases from muySafe.

10. Privacy Policy

Your personal information is collected and handled according to our Privacy Policy and Shopify’s privacy practices.
By using our Services, you consent to these policies and acknowledge that Shopify processes some information to operate the platform and payments.

11. Feedback & Reviews

By submitting feedback, reviews, or suggestions (“Feedback”), you grant muySafe a perpetual, worldwide, royalty-free license to use and display it for purposes such as improving or promoting our Services.

You represent that your Feedback is accurate and lawful, and you waive any claim to compensation for its use.

12. Errors & Corrections

We may correct errors, inaccuracies, or omissions (including pricing or availability) at any time without prior notice, even after an order is submitted.

13. Prohibited Uses

You may use our Services only for lawful purposes. You agree not to:

Violate intellectual property rights;
Upload viruses or malware;
Send spam or fraudulent content;
Harass or harm others;
Circumvent security features.

We reserve the right to suspend or terminate your account for violations of these Terms.

We make no guarantees of uninterrupted or error-free service and disclaim all implied warranties of merchantability or fitness for a particular purpose.

16. Limitation of Liability

To the maximum extent permitted by law, muySafe, its officers, employees, contractors, and affiliates shall not be liable for indirect, incidental, or consequential damages, including lost profits or data, resulting from your use of the Services or products.

17. Indemnification

You agree to indemnify and hold harmless muySafe and Shopify from any claims or damages arising from your use of the Services, breach of these Terms, or violation of any law or third-party rights.

18. Severability

If any provision of these Terms is deemed unlawful or unenforceable, it shall be enforced to the fullest extent possible, and the remainder will continue in full effect.

19. Waiver & Entire Agreement

Failure to enforce any part of these Terms does not waive our rights.
These Terms and the related policies represent the entire agreement between you and muySafe and supersede all prior communications.

20. Assignment

You may not transfer or assign these Terms without our written consent.
muySafe may assign its rights and obligations without notice.

21. Governing Law & Jurisdiction

These Terms and any disputes related to the Services shall be governed by and construed under the laws of the State of Florida.
You agree to the exclusive jurisdiction of courts located in Miami-Dade County, Florida.

Headings are for convenience only and do not affect interpretation.

23. Changes to Terms of Service

We may update or modify these Terms at any time by posting an updated version on our website.
Your continued use of our Services after changes are posted constitutes acceptance.
